CHARLESTON, W.Va.- The West Virginia Division of Motor Vehicles would like to remind the driving public of new school bus legislation that was passed during the most recent Legislative Session. House Bill 4223, nicknamed “Haven’s Law” for Haven McCarthy, increases the penalties for overtaking and passing a school bus stopped for the purpose of receiving and discharging children. McCarthy, 6, was killed in West Hamlin after getting off a school bus in 2007.
According to DMV Commissioner Joe Miller, “The DMV would like to remind all motorists to be watchful of school buses, especially as they are loading and unloading passengers. House Bill 4223 not only stiffens the financial penalties for passing a stopped school bus, but requires DMV to suspend a motorist’s license if so convicted. The purpose of this law is to ensure the safety of our most precious cargo.”
The National Highway Traffic Safety Administration reports that more accidents involving school buses occur when children are getting on and off the bus as pedestrians, rather than while they are riding on the school bus. Motorists need to be cognizant of school buses, slow down in school zones, and always obey the stop arm of a school bus.
